By submitting video or photos to us or a Yovia network site, you are granting worldwide rights to the content to Yovia, LLC. It is your responsibility to provide proper credit or secure rights to any content you upload to Yovia. Yovia reserves the right to remove any questionable content.

Disclaimer and limitation of liability

The Yovia website(s) and Yovia Network Sites contains material on an “as is” basis, meaning there are no applicable warranties or guarantees associated with activities, games, images, text, contests, etc. Users cannot cite such guarantees or warranties, as they do not exist. Yovia, LLC is not responsible or liable for any infections or contamination of your system, or delays, inaccuracies, errors, or omissions arising out of your use of this. PROMOTIONS: Opportunities, games, contests, free giveaways, sweepstakes, and other activities
Any "Enter to Win” or "Giveaway" promotion (the "PROMOTION") gives you an opportunity to win a prize or recieve a free item as detailed on the page where the PROMOTION is being offered. The details of the PROMOTION and how to enter the PROMOTION are contained in the Official Rules which are listed on the PROMOTION page.

Any PROMOTION being offered by Yovia is void where prohibited. There is never any purchase or opt-in required to participate in a promotion, and anyone may participate in a promotion online, or by mailing a request to Yovia, LLC, 1372 Beach Blvd. Jacksonville Beach, FL. Sweepstakes may be subject to additional terms outlined on the PROMOTION page, and free giveways are always subject to limited supplies. Yovia and Yovia sponsors make best efforts to provide merchandise and promotions to people in the order that they are requested, however in some cases only eligible participants may recieve free merchandise. In most cases, Yovia only ships free merchandise within the continential United States. Anyone over the age of 18 may participate in ongoing Yovia blogging, Facebook, Twitter and other opportunities made available via Yovia.com, via Social Networks and or mobile devices. Yovia reserves the right to withold earnings, free merhchandise and other incentives related to any PROMOTION at it's sole discretion. SPAMMERS, bots and fraudulent activities may be reported to the appropriate authorities.

PAYMENTS.
You may claim opportunities and view your potential earnings each month via your Opportunity Dashboard. You must mark these opportunities as complete. Yovia verifies each completion and immediately blocks any users who attempt to defraud the system. You may only use one Facebook account to connect to Yovia. Yovia reserves the right to hold payment at their discretion. In general, payment is made by the 10th of each month for the previous month's earnings. Some exceptions may apply, including scenarios where the opportunity requires the sponsor to confirm the claim, and or where Yovia is paid on 30, 60 or 90 day terms.

USE OF DATA.
Yovia will be collecting personal data about participants (including, without limitation, e-mail addresses, phone number and address) when they participate in a PROMOTION. By participating in the PROMOTION, entrants hereby agree to all personal information uses and disclaimers as explained in Yovia's Privacy Policy: http://yovia.com/privacy.html.

ELIGIBILITY.
PROMOTIOPNS are open to anyone 18 years or older who are residents of the fifty United States and the District of Columbia (excluding Puerto Rico) who are (i). PROMOTIONS are Void where prohibited by law. Employees of Yovia, the sponsoring company, or their affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners).

AGREEMENT TO OFFICIAL RULES.
Participation in the PROMOTION's entrant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's Privacy Policy http://yovia.com/privacy.html and to be contacted by telephone and/or email.

SELECTION OF POTENTIAL WINNER.
In the case of a contest or sweepstakes conducted by Yovia and the sponsoring company winner(s) will be selected by random drawing. In some cases, such as a PROMOTION that involves user submitted content, we reserve the right to narrow entrants down to a group of finalists based on our discretion. Yovia's decisions as to all matters related to administration of the PROMOTIONS and selection of winners are final. All potential winners must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner(s) from the drawing will be notified by email or telephone within ten (10) days of the drawing. If any of the potential winner(s) cannot be contacted, an alternate entrant will be selected in his or her place at random from all eligible entries received.

NO CASH OR OTHER SUBSTITUIONS ARE PERMITTED, EXCEPT BY YOVIA/SPONSORING COMPANY, WHO RESERVE THE RIGHT TO SUBSTITUTE THE PRIZE WITH ONE OF EQUAL OR GREATER VALUE.

All federal, state and local taxes related to the Prize and the other prizes are the sole responsibility of Prize Winner. All other expenses and costs, not expressly listed above, including but not limited to applicable taxes, are the Prize Winner's sole responsibility. No refunds or credit for changes are allowed. No transfer of the Prize is permitted. All potential winners must execute and return an Affidavit of Eligibility/Release of Liability and Publicity within FIVE (5) days of notification. Noncompliance within this time period may result in disqualification, and an alternate Prize Winner or other winner(s) may be selected, as applicable. Return of any prize notification as undeliverable may result in disqualification and selection of any alternate winners.

GENERAL CONDITIONS.
All Yovia PROMOTIONS are governed by the laws of the United States and the State of Florida, and participants in the PROMOTIONS hereby consent to the exclusive jurisdiction and venue of Duvall County, Florida courts (state and federal) for any causes or controversies arising out of the PROMOTION. Each participant waives any and all objectives to jurisdiction and venue in these courts. All applicable federal, state and local laws and regulations apply. Void where prohibited. By participating in any Yovia PROMOTION, you automatically agree to indemnify Yovia including any Yovia partners, customers, sponsors, affiliates, contractors and or employees from any and all damages.

Except where prohibited by law, the Winner grants to Yovia and the sponsoring company and their advertising agencies the right to use and publish their photos, proper names, likeness, voices, opinions, biographical information and state in any media to promote the PROMOTION and sponsor without any additional compensation.

Yovia reserves the right to cancel or modify the PROMOTION if fraud or any other factor impairs the integrity of the Sweepstakes as determined by Yovia in its sole discretion.

If, in Yovia’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the PROMOTION or if technical difficulties compromise the integrity of the PROMOTION, Yovia reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers with the entry process), and to cancel, terminate, modify or suspend the PROMOTION, in whole or in part, at any time without notice. In the event of such cancellation, Yovia reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation.

Yovia and the sponsor company assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Yovia is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Yovia on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, YOVIA RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
